MANDATORY ACL NOTICE: Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
1. Definitions
In these Terms:
Agreement: any agreement between Apollo Scooters Pty Ltd (Apollo, we, us) and a Customer incorporating these Terms, as amended from time to time.
Customer / you / your: a person or entity in Australia who purchases Products or Services from Apollo or uses our Australian website or support channels.
Services: services we provide that relate to the purchase, setup, maintenance or repair of Products.
Product(s): electric scooters and related accessories supplied by Apollo.
Scooter(s): Apollo-branded electric scooters.
Order: a request by you to purchase Products and/or Services.
Privacy Policy: Apollo’s AU privacy policy describing how we handle personal information.
2. Applicability
2.1 Scope
These Terms apply to all purchases, deliveries and Services made within Australia via apolloscooters.au, any Apollo Repair Centre located in Australia, or through our Australian customer-support channels. They govern every offer, sale, supply or related Service by Apollo Scooters Pty Ltd (“Apollo”, “we”, “us”) to a Customer (“you”).
If you are an Australian consumer, your rights under the Australian Consumer Law (ACL) apply in addition to these Terms and prevail over any inconsistent term.
2.2 Formation of Agreement
By placing an Order, you accept these Terms and any other written terms agreed with Apollo. Each accepted Order creates a separate Agreement between you and Apollo.
2.3 Eligibility.
To place an Order, you must:
(a) be at least 18 years old and have legal capacity to contract; and
(b) provide a valid email address and delivery address within Australia.
2.4 Delivery area.
Apollo delivers Products only within Australia. If you provide a delivery address outside Australia, we may decline or cancel the Order and promptly refund any amount you have paid.
2.5 Customer responsibility.
You are responsible for using and operating your Scooter safely and lawfully, including complying with all road, traffic, insurance and local-use rules that apply in your state or territory. These rules can vary by jurisdiction. It is your responsibility to understand and follow them.
2.6 Acceptance of Terms.
Placing an Order through our website or app confirms that you have read and accepted these Terms, as well as any applicable app or software terms of use.
2.7 Customer terms excluded.
Any customer-supplied terms or conditions (including those in a purchase order, invoice, or other document) are expressly rejected and have no effect unless Apollo agrees to them in writing. For clarity, only the description of the Product, quantity and requested delivery details stated in your Order form are accepted; all other conditions are governed by these Terms and the Agreement.

4. Quotations, Agreements, Product descriptions, Integrated Services
Quotes may specify validity periods or conditions. A contract is formed when we email you an order confirmation. If we cannot supply a Product, we will refund any amounts you have paid for that Product.
We take reasonable care describing Products; small variations may occur. If a Product materially deviates from the description or sample, you may be entitled to an ACL remedy (Section 14) within a reasonable time.
Some features may rely on third‑party networks or integrations which may change or be interrupted. This does not limit your ACL rights.
To access all features, you may need the latest Apollo app and a compatible mobile device and connection. Your carrier/ISP charges may apply.
5. Apollo Limited Warranty
Our voluntary Limited Warranty for Australia is set out in Section 14 and operates in addition to your ACL rights. Where there is any inconsistency, your ACL rights prevail. Time limits or exclusions in our voluntary warranty do not affect ACL remedies.
6. Apollo Ship+ Service
Not offered in Australia. Any references to Ship+ in global materials do not apply to Australian customers.
7. Prices
Prices on the Australian website are in AUD and include GST unless stated otherwise. Delivery charges (if any) are shown at checkout. We will always show the total price before you place your Order.
9. Shipping and Delivery
9.1 Delivery area.
Apollo Scooters delivers Products only to physical addresses within Australia. We do not deliver to PO boxes, parcel lockers, or addresses outside Australia. Orders with a delivery address outside these locations may be declined or cancelled, with any payments promptly refunded.
9.2 Delivery timeframe.
Delivery times are estimates only and are based on the circumstances known to Apollo Scooters when the Agreement is entered into. Estimated delivery times will be communicated at checkout or in your Order confirmation. While we make reasonable efforts to deliver within the estimated timeframe, delays may occasionally occur due to factors beyond our control (such as carrier delays or supply chain disruptions).
9.3 Passing of risk.
Risk of loss or damage to the Products passes to you only when the Products are delivered to you or to a person you nominate (other than the carrier). Until that time, Apollo Scooters remains responsible for the Products. If you arrange your own courier (not offered or arranged by Apollo Scooters), risk transfers to you when the Products are collected by that carrier.
9.4 Delivery commencement.
Delivery timeframes commence from the date Apollo Scooters confirms your Order in writing and receives all required information or documentation necessary to process it.
9.5 Delays and remedies.
If delivery is delayed, Apollo Scooters will notify you as soon as reasonably practicable. Nothing in these Terms limits your rights under the Australian Consumer Law. If delivery is not made within a reasonable time, you may be entitled to a remedy such as a replacement, refund, or cancellation, in accordance with your rights under the ACL.
9.6 Partial deliveries.
Apollo Scooters may deliver Orders in multiple shipments if required. Each shipment will be treated as part of the same overall Order and governed by these Terms.
10. Right of withdrawal
Australian law does not provide a general “right of withdrawal” for change‑of‑mind purchases. In addition to your ACL rights, we offer a 14‑day change‑of‑mind return policy for unused goods in saleable condition with all accessories. We may charge reasonable return freight and a restocking fee. This policy does not affect your ACL rights for faulty goods.
11. Delivery and risk
11.1 Delivery point and transfer of risk.
Unless otherwise agreed in writing, delivery of Products occurs when the Products are physically delivered to you or to a person you nominate (other than the carrier) at the delivery address specified in your Order. Until that time, all risk of loss or damage to the Products remains with Apollo Scooters. IIf you arrange your own courier or freight provider (not offered or arranged by Apollo), risk transfers to you when the Products are collected by that carrier. Nothing in this clause limits your rights under the Australian Consumer Law.
11.2 Ownership (title).
Title to the Products passes to you only once full payment has been received by Apollo Scooters in cleared funds.
Until title passes, you must:
(a) hold the Products as bailee for Apollo Scooters;
(b) not sell, lease, pledge, or otherwise encumber them; and
(c) keep them in good condition and clearly identifiable as Apollo Scooters’ property.
11.3 Failure to accept delivery.
If you fail or refuse to take delivery of the Products when they are ready for delivery, Apollo may, at its discretion and without limiting any other rights:
(a) store the Products at your cost and risk (including reasonable storage and insurance charges); and/or
(b) after giving you reasonable notice, resell the Products.
If the Products are resold, you remain liable for any shortfall between the original purchase price and the net proceeds of the resale (after reasonable costs), consistent with applicable law.
11.4 Consumer protection.
For customers who are consumers under the ACL, risk passes on delivery as described in 11.1, and you retain all statutory rights and remedies.
No clause in this Agreement limits your ability to obtain a remedy under the Australian Consumer Law for any delay, loss, or failure in delivery.
12. Inspection and Complaints
12.1 Inspection on delivery.
You should carefully inspect the Products as soon as reasonably possible after delivery and before first use. If any items appear damaged, missing, or inconsistent with your Order, please contact support@apolloscooters.au promptly and, where possible, provide photos or a short description of the issue.
12.2 Reporting issues.
To help us resolve problems quickly, please notify Apollo Scooters in writing:
-
Within 5 calendar days of delivery for visible damage, quantity, or specification discrepancies; and
-
As soon as reasonably practicable after discovery for issues that could not have been identified earlier.
Providing clear details (and photographs if available) allows us to assess and address the concern efficiently.
Note: Failure to notify within these suggested timeframes will not remove or limit your rights under the Australian Consumer Law.
12.3 Ceasing use.
If you notice a defect, irregularity, or potential safety issue, you must immediately stop using the Product and contact Apollo Scooters for guidance. Continued use of a defective or unsafe Product may cause further damage or safety risk and could affect our ability to assess the issue properly.
12.4 Investigation cooperation.
You agree to provide reasonable assistance—such as photos, videos, or basic information—so Apollo Scooters can inspect, test, or diagnose the issue. In some cases, we may request that the Product be sent to an authorised repairer or Apollo Repair Centre for evaluation.
12.5 Product returns.
Please do not return any Product until Apollo Scooters has confirmed the return procedure in writing.

For faulty goods covered by the ACL, Apollo Scooters will bear the reasonable return shipping costs.

For change-of-mind returns under our voluntary policy, you are responsible for freight and any applicable restocking fee as described in Section 10.

The Products remain your responsibility until Apollo Scooters (or our authorised repairer) receives them.
12.6 Customer obligations.
You must:
(a) Provide accurate and complete information required for Apollo Scooters to perform its obligations;
(b) Keep all identification numbers, trademarks, and safety labels on the Products visible and intact; and
(c) Not copy, modify, reverse engineer, decompile, disassemble, or otherwise tamper with the Products, their components, software, or related Services.
12.7 Preservation of statutory rights.
Nothing in this Section 12 limits or excludes any rights or remedies you have under the Australian Consumer Law, including your entitlement to repair, replacement, refund, or compensation for a major or non-major failure.
13. Maintenance, Service and Repair
13.1 General Maintenance Requirements
(a) Customer responsibility for maintenance
You acknowledge that proper and regular maintenance of your Scooter is essential to ensure safe, reliable, and efficient operation.
You must follow the maintenance and safety guidelines provided in the owner’s manual, on-product labels, and any other documentation supplied by Apollo Scooters.
Failure to perform routine maintenance may lead to unsafe operation or damage and could affect your ability to claim under our voluntary Limited Warranty (see Section 14).
(b) Proof of maintenance
Apollo Scooters may reasonably request proof of maintenance (for example, logs or receipts from an authorised or Certified Shop) to help diagnose product faults or assess warranty claims.
(c) Responsibility for misuse or neglect
If damage or failure occurs because maintenance was not performed as recommended, Apollo Scooters may decline a voluntary warranty claim.
However, this does not affect your rights under the Australian Consumer Law, which apply regardless of warranty status.
13.2 Safety and Liability
(a) Safe operation
Always ensure your Scooter is safe before use. Stop using the Scooter immediately if you suspect a defect, mechanical issue, or structural damage.
If a Scooter is found unsafe, Apollo Scooters or a Certified Shop may declare it “unsafe to ride” and will inform you accordingly.
(b) Apollo’s advice regarding unsafe Scooters
If a Scooter is declared unsafe to ride, Apollo Scooters will offer one of the following options:

Recycling offer: Apollo may purchase usable components for re-use and recycle the remainder.
-
Trade-in voucher: A discount voucher (based on depreciation and assessed value) towards the purchase of a new Apollo Scooter.
-
Return of the unsafe unit: You may request the return of the Scooter after signing an acknowledgement confirming you understand the safety risks. The Scooter will not be eligible for further servicing through Apollo or Certified Shops.
Apollo Scooters strongly advises against riding a Scooter that has been declared unsafe.Nothing in this clause limits your statutory rights under the Australian Consumer Law.
13.3 Servicing, Repairs and Spare Parts
(a) Certified Shops
Apollo Scooters does not operate its own repair centres in Australia.
Repairs and servicing are provided by independent Certified Shops that meet Apollo’s technical standards. Certified Shops are responsible for the quality and workmanship of their repairs. Apollo Scooters is not responsible for the actions, timelines, or compliance of these independent repairers.
If you engage a Certified Shop:
-
The repair contract is between you and the Certified Shop.
-
Any concerns about workmanship, turnaround, or charges must be addressed directly with that repairer.

Certified Shops must comply with Australian laws, including data-protection and consumer-guarantee requirements.
(b) Turnaround and parts availability
Certified Shops aim to complete repairs promptly and will communicate an estimated completion date. Repair times may vary depending on parts availability, supplier delays, or other external factors. Apollo Scooters and Certified Shops will inform you of significant delays and, where possible, provide updated timeframes.
(c) Spare-part supply
Apollo Scooters maintains an inventory of common parts and will make reasonable efforts to ensure their availability. If parts are temporarily unavailable, you will be notified of the estimated procurement time. Delays caused by factors beyond our control (for example, shipping or customs delays) do not remove your ACL rights.
13.4 Customer Obligations
You must:
(a) Provide accurate information needed for diagnosis or repair;
(b) Not remove or obscure safety labels or serial numbers;
(c) Not copy, modify, reverse engineer, or tamper with any software or hardware; and (d) Use only authorised parts and accessories where required for safe operation.
13.5 Changes to Maintenance Guidance
Apollo Scooters may update or amend maintenance and service guidelines to improve safety or performance. Updated information will be made available via the owner’s manual, website, mobile app, or email notices. Customers are encouraged to check these channels periodically for the most current guidance.
14. Limited Warranty
14.1 Scope
Apollo Scooters Pty Ltd (“Apollo”, “we”, “us”) provides this Limited Warranty to Australian customers who purchase Apollo Scooters products (“Products”) directly from apolloscooters.au or through an authorised Australian retailer or Certified Shop.
This Limited Warranty applies in addition to your rights under the Australian Consumer Law (ACL) and does not limit or replace those rights. Our goods come with guarantees that cannot be excluded under the ACL. You are entitled to a replacement or refund for a major failure, and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.
14.2 Warranty Coverage and Duration
Subject to the conditions below, Apollo provides the following voluntary warranty coverage from the date of delivery:

14.3 Conditions for Warranty
This Limited Warranty applies only when:
(a) The Product has been properly assembled, maintained, and used according to Apollo’s user manual and maintenance guidance (see Section 13).
(b) Repairs or service have been carried out only by Apollo-authorised Certified Shops or technicians.
(c) The Product has not been subject to accident, misuse, neglect, unauthorised modification, water ingress beyond the stated IP rating, or the use of non-approved parts or accessories.
14.4 Exclusions
This Limited Warranty does not cover:
-
Normal wear and tear or consumables (e.g. tyres, brake pads, bearings, grips, cables, and cosmetic items).
-
Damage from accidents, misuse, unauthorised modifications, improper assembly, over-tightening of screws, or commercial use.

Damage caused by water ingress beyond the stated IP rating or from exposure to corrosive elements
-
Damage caused by improper charging, aftermarket chargers, power surges, or incorrect storage.
-
Cosmetic deterioration including fading, scratching, or rust that does not affect performance.
-
Software or firmware faults caused by failure to install recommended safety updates.
-
Damage caused by the use of third-party accessories, or alterations not approved by Apollo Scooters.
-
Routine servicing costs, or issues resulting from non-Certified Shop repairs.
Note: Exclusions under this Limited Warranty do not affect your statutory rights under the ACL.
14.5 Warranty Claims Procedure
To make a warranty claim:
-
Contact support@apolloscooters.au with your order number, description of the fault, and photos or videos where possible.
-
Apollo will assist with troubleshooting and, if required, refer you to a Certified Shop for inspection.
-
For Products requiring return shipment, Apollo will issue a return authorisation and provide packaging instructions.
-
For ACL-related remedies (faulty or unsafe goods), Apollo will cover reasonable return shipping costs.
-
For voluntary warranty claims where the Product is not faulty under the ACL, the customer may bear return freight.
Repairs under this Limited Warranty do not reset or extend the original warranty period.
14.6 Transfer of Warranty
The unexpired balance of this Limited Warranty may be transferred once within Australia to a new owner. The transfer requires written notice to Apollo via support@apolloscooters.au, providing the original purchaser’s name, order number, and the new owner’s details.
14.7 Repair Notice (Required by Law)
Goods presented for repair may be replaced by refurbished goods of the same type rather than being repaired. Refurbished parts may be used to repair the goods.
Some data (including ride logs or settings) may be lost during service. Please back up your data before returning the Product.
14.8 Remedies
If a Product is found to have a manufacturing defect covered by this Limited Warranty, Apollo will, at its discretion:
-
Repair the affected part; or
-
Replace the Product or component with a new or equivalent refurbished part of similar value and function.
This voluntary warranty remedy is in addition to your ACL rights, not a substitute for them.
14.9 Packaging and Shipping
Products must be returned using safe and suitable packaging. You may use the original box or request a replacement shipping box from Apollo (available at cost). The Product remains your responsibility until received by Apollo or the Certified Shop.
14.10 Certified Shop Repairs
Repairs performed by a Certified Shop under this Limited Warranty are guaranteed for 30 days from the date of completion, covering the repaired part only.
Apollo Scooters is not responsible for delays or workmanship issues arising directly from a Certified Shop’s independent repair operations.
14.11 Limitation of Liability
Nothing in these Terms excludes or limits any rights or remedies you have under the Australian Consumer Law.
To the extent permitted by law and except as required by the ACL:
-
Apollo Scooters’ liability is limited to the repair, replacement, or refund of the Product; and
-
Apollo is not liable for indirect or consequential loss, loss of use, or damage beyond the cost of the Product itself.
14.12 Governing Law
This Limited Warranty is governed by the laws of New South Wales and the laws of Australia.
15. Safe Operation, Assumption of Risk, and Indemnification
15.1 Customer understanding and obligations.
Before riding any Apollo Scooter, you confirm that you:
(a) have read and understood all operating instructions, warnings, and manuals supplied with the Product;
(b) are physically able and competent to operate the scooter safely;
(c) understand the local road rules, traffic laws, and e-scooter regulations applicable in the area where you ride; and
(d) will wear appropriate protective gear, including a helmet, at all times.
15.2 Awareness of risk.
Riding an electric scooter involves inherent risks — including potential injury, collision, falls, or adverse interactions with road, weather, or traffic conditions. You acknowledge that, as with any vehicle or physical activity, responsible operation and maintenance are essential for your safety and that of others.
15.3 Your responsibilities.
You are responsible for:
-
Ensuring your scooter is in safe working order before use (e.g., checking tyres, brakes, lights, and steering).
-
Riding in accordance with local laws and conditions.
-
Avoiding unsafe speeds, stunts, or operation under the influence of alcohol or drugs.
-
Keeping your scooter maintained in accordance with the owner’s manual and any Apollo maintenance recommendations.
15.4 No exclusion of statutory rights.
Nothing in this Section 15 limits your rights under the Australian Consumer Law, including your entitlement to remedies for goods that are not of acceptable quality, not fit for purpose, or unsafe. Apollo Scooters does not exclude or limit liability where it would be unlawful to do so.
15.5 Customer assumption of ordinary risks.
To the extent permitted by law, you acknowledge and accept responsibility for ordinary, foreseeable risks inherent in using a scooter for personal transportation (for example, minor scrapes or falls arising from rider inattention or local road conditions). This does not affect Apollo’s liability for any defect in design, manufacture, or warnings that would breach consumer guarantees under the ACL.
15.6 Indemnity for misuse or unlawful operation.
You agree to indemnify and hold harmless Apollo Scooters, its officers, and employees against any third-party claims, losses, or damages arising directly from your misuse of the Product, unlawful operation, or failure to comply with local regulations — except to the extent such loss or damage was caused or contributed to by Apollo’s negligence, breach of contract, or breach of the ACL.
16. Employee Protection Policy
We do not tolerate discriminatory, abusive, or harassing behaviour toward our staff or partners and may refuse service in such cases.
17. Force majeure
17.1 Definition.
A “force majeure event” means any event or circumstance beyond the reasonable control of Apollo Scooters or the Customer that prevents or materially delays the performance of their obligations under these Terms. Force majeure events include, but are not limited to: natural disasters, fires, floods, severe weather, pandemics, acts of terrorism, strikes, lockouts, labour shortages, war or civil unrest, government restrictions, supply-chain disruptions, transport failures, or the inability to obtain necessary materials, permits, or authorisations.
17.2 Suspension of obligations.
If a party is affected by a force majeure event, its obligations (other than payment obligations already due) are suspended for the duration of the event to the extent they cannot reasonably be performed.
17.3 Notification.
The affected party must notify the other party as soon as reasonably practicable after becoming aware of the event, providing details of its expected duration and the impact on performance.
17.4 Termination rights.
If a force majeure event continues for more than 30 consecutive days, either party may terminate the Agreement in whole or in part by written notice. Termination under this clause does not entitle either party to claim damages arising solely from the non-performance during the force majeure event.
17.5 Exclusions of liability.
Except to the extent required under the Australian Consumer Law, neither party will be liable to the other for any loss or damage arising from delay or failure to perform its obligations caused by a force majeure event.
17.6 Mitigation.
Each party must take all reasonable steps to minimise the effects of the force majeure event and to resume full performance of its obligations as soon as reasonably practicable.
18. Intellectual Property
All site content, software, logos and materials are owned by us or our licensors. You must not copy or distribute them except as permitted by law or with our written consent.
19. Limitation of Liability
19.1 Statutory rights.
Nothing in these Terms limits or excludes your rights under the Australian Consumer Law (ACL).
19.2 Non-consumer supplies.
Where goods or services are not ordinarily for personal, domestic, or household use, Apollo’s liability is limited (at its option) to:
-
for goods: repair, replacement, or payment of the cost of either;
-
for services: re-supply or payment of the cost of re-supply.
19.3 Exclusion of indirect loss.
To the extent permitted by law, Apollo Scooters is not liable for any indirect, special, or consequential loss, including loss of profit, revenue, data, or opportunity, arising from the use or performance of the Products or Services.
19.4 Liability cap.
Subject to the ACL, Apollo’s total liability for all claims connected to a Product or Service is limited to the amount paid for that Product or Service or AUD $10,000, whichever is less.
19.5 No exclusion for negligence.
This clause does not exclude liability for death, personal injury, or loss caused by Apollo’s negligence, or for any liability that cannot be excluded under Australian law.
20. Termination
We may suspend or cancel an Order if payment is not received or if fraud is suspected. Any termination rights will be exercised consistently with the ACL and without imposing unfair penalties.
21. Hardware, Software, and Firmware Maintenance and Updates
21.1 Purpose of updates.
To maintain safety, reliability, and functionality, Apollo Scooters may from time to time issue updates or modifications to its Products and Services, including hardware, software, or firmware. Updates may add, modify, or remove certain features.
21.2 How updates are provided.
Updates may be:
-
downloaded and installed by you on your mobile device or Product (manually or automatically);
-
installed by Apollo Scooters or a Certified Shop during servicing or repair; or
-
applied remotely where the Product is connected to Apollo’s systems.
21.3 Temporary suspension.
Apollo Scooters may temporarily suspend Services to perform maintenance, system upgrades, or safety checks. Where practicable, we will provide prior notice of such interruptions.
21.4 Outdated systems.
Support for older mobile devices or software versions may be discontinued where those systems are no longer secure or compatible. This may cause certain connected features to become unavailable without prior notice.
21.5 Customer responsibilities.
You agree to promptly install safety or performance-related updates provided by Apollo Scooters. Failure to install essential updates may affect Product functionality or limit our ability to provide support or voluntary warranty coverage.
This does not limit your rights under the Australian Consumer Law, including guarantees that goods will remain of acceptable quality.
21.6 Firmware management.
Apollo Scooters routinely updates firmware during servicing to ensure safety and performance. We do not perform firmware downgrades and cannot accommodate requests to skip mandatory safety updates.
21.7 Third-party applications.
Apollo Scooters is not responsible for the functionality or compatibility of third-party apps before, during, or after maintenance or updates, except where required by law.
22. Connect+
22.1 Overview.
Connect+ is an optional connected-service program offered by Apollo Scooters for eligible Apollo Pro models with IoT capability. It enables enhanced safety, connectivity, and tracking features.
22.2 Eligibility and account.
To access Connect+, you must:
-
own an Apollo Pro scooter with IoT functionality enabled;
-
create and maintain a valid Apollo account (“Account”) in good standing; and
-
comply with these Terms and any Connect+ service conditions shown in the Apollo App.
You are responsible for all activity on your Account and must keep your login details secure. Notify Apollo Scooters immediately at support@apolloscooters.au if you suspect unauthorised access. Apollo is not responsible for losses caused by unauthorised use of your Account unless required by law.

Connect+ may rely on mobile networks, GPS, and third-party service providers. Availability may vary depending on location, coverage, or technical updates. Apollo may modify, suspend, or discontinue Connect+ features at any time for maintenance, safety, or compliance reasons.
22.4 Data collection and privacy.
By activating Connect+, you consent to Apollo Scooters collecting and processing certain data to operate the service, including:

Personal Information (e.g. name, contact details, account data); and

Ride and location data (e.g. GPS, trip history, diagnostics).
All Personal Information is handled in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. Details are available in Apollo’s Privacy Policy at apolloscooters.au/policies/privacy-policy.
Apollo may use reputable third-party data hosts within or outside Australia, provided reasonable steps are taken to ensure data protection consistent with the APPs.
22.5 Prohibited conduct.
You must not:

access or use Connect+ for unlawful purposes;

interfere with system security or network operations;

reverse-engineer or modify the software;

copy, scrape, or reproduce data or content from Connect+; or
-
share, sell, or transfer your Account access.
22.6 Termination and service changes.
Apollo Scooters may suspend or terminate Connect+ access (with notice where practicable) if you breach these Terms or misuse the service. Features and fees may change over time.
22.7 Payment processing.
Connect+ payments are processed via Stripe through the Apollo App. By subscribing, you agree to Stripe’s Terms of Service.
22.8 No exclusion of rights.
Nothing in this Section limits your rights under the Australian Consumer Law, including guarantees for services supplied with due care and skill.
23. Transfer of rights and obligations
We may assign our rights/obligations where lawful and with notice to you. You must not assign your rights without our consent, except as permitted by law. Assignment terms will not reduce your statutory rights.
24. Privacy
We handle personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. See our Australian Privacy Policy at apolloscooters.au/policies/privacy-policy for details on collection, use, disclosure, overseas storage, and how to access/correct information or make a privacy complaint. Some app/IoT features may collect location/ride data with your consent; you can manage permissions in your device/app settings.
25. Conversion
If a provision is invalid or unenforceable, it will be read down to the extent necessary to be valid and enforceable, or severed if required, without affecting the remaining provisions.
26. Applicable law
These Terms are governed by the laws of New South Wales and the laws of Australia. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
27. Severability
If any term is invalid, illegal or unenforceable in a jurisdiction, that term is severed to the extent of the invalidity, illegality or unenforceability, without affecting the remaining terms or the validity of that term in any other jurisdiction.
28. Amendment of Terms
We may update these Terms for future purchases by posting the new version on our Australian website. Changes do not affect Orders already accepted unless required by law or agreed.
Disputes: Please contact support@apolloscooters.au. If unresolved, you may seek assistance from your state/territory fair‑trading body or the ACCC, or commence proceedings in an Australian court or tribunal of competent jurisdiction. No mandatory foreign arbitration or class‑action waiver applies to Australian customers.
